Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Build Speedy ("Build Speedy", "we", "us", "our"), an independently operated product run by a solo developer based in Vietnam, providing the Build Speedy desktop application and the website at buildspeedy.pro (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Build Speedy is a desktop application that helps you plan, generate, extend, and analyze mobile app projects (including React Native, SwiftUI, and Kotlin Multiplatform targets). It orchestrates prompts, manages project context, and writes files on your local machine.

3. Eligibility & Accounts

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us at support@buildspeedy.pro if you suspect unauthorized access.

4. Subscriptions, Billing & Auto-Renewal

Most Build Speedy features require a paid subscription. Payments are processed by our merchant of record, Paddle.com, which also handles applicable taxes and invoicing. By subscribing you also agree to Paddle's Buyer Terms.

• Subscription fees are billed in advance on a recurring basis (monthly or annually) at the price shown at checkout.
• Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. Promotional or "locked-in" prices renew at that locked rate as long as your subscription remains active and uninterrupted.
• You may cancel at any time from your account or by contacting support@buildspeedy.pro. Cancellation takes effect at the end of the current billing period; you keep access until then.
• If a payment fails, we may suspend access until payment is resolved.
• We may change prices for new billing periods on at least 30 days' notice. Changes do not apply retroactively to a billing period already paid for.

5. Refunds

We offer a 7-day refund window from the date of your initial purchase. See our Refund Policy for full details, including how to request a refund.

6. Your Code and Data

Build Speedy is local-first. Your project files, prompts, and the source code generated or edited by Build Speedy on your machine remain on your machine; we do not store them on our servers. The Build Speedy CLI components run locally and may write to your project folder when you authorize them to.

• You own the output. As between you and Build Speedy, you own the code Build Speedy generates for your project, subject to any third-party licenses (including those of your AI provider and any open-source dependencies).
• You are responsible for backups. Because we do not store your project content, you are responsible for version control, backups, and protecting your local device.
• AI output disclaimer. AI-generated code may contain bugs, security flaws, hallucinated APIs, or material that resembles existing code. You are responsible for reviewing, testing, and licensing-checking all generated code before using it in production.

7. Third-Party Services & AI Providers

The Service depends on third parties including Anthropic (Claude Code CLI), OpenAI (Codex CLI), Paddle (payments), Cloudflare (hosting), and PostHog (product analytics). Your use of those services is governed by their own terms and policies, and your relationship with your AI provider is independent of Build Speedy. We are not responsible for outages, content, billing, or policy changes by third parties.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law, including export-control, sanctions, IP, privacy, or consumer-protection laws.
• Use the Service to generate or distribute malware, phishing tooling, content that infringes a third party's rights, content that targets minors sexually, or content that violates the usage policies of your AI provider (e.g., Anthropic's AUP, OpenAI's Usage Policies).
• Reverse-engineer, decompile, or disassemble the Service, except where this restriction is prohibited by law.
• Resell, sublicense, or repackage the Service itself; share access credentials; or operate it as a managed service for third parties without our written permission.
• Probe, scan, or attempt to breach the security of the Service or its infrastructure, or interfere with other users.
• Use the Service to train a competing AI model or to systematically benchmark the Service for the purpose of building a competing product.

9. Intellectual Property

Build Speedy, including the desktop application, website, design systems, templates, themed components, and supporting CLIs, is the property of Build Speedy and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription. All rights not expressly granted are reserved.

10. Beta Features

Some features may be released as beta, preview, or experimental. They may change, break, or be removed without notice and are provided "as is" without any service-level commitment.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted or error-free. We do not warrant that AI-generated output will be correct, secure, original, or suitable for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, Build Speedy and its operator shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service. Our total aggregate liability for all claims arising out of or relating to the Service in any 12-month period shall not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim or (b) USD 100. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the above limitations apply only to the extent permitted by law and do not affect your statutory rights as a consumer.

13. Indemnification

You agree to indemnify and hold harmless Build Speedy and its operator from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) content or projects you create using the Service, or (c) your violation of any third party's rights, including IP and privacy rights.

14. Suspension & Termination

You may stop using the Service at any time and cancel your subscription as described above. We may suspend or terminate your access (with or without notice, and with a pro-rated refund where required by law) if you materially breach these Terms, if your account poses a security or legal risk, or if continuing to provide the Service to you becomes commercially or legally impractical. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Global Compliance

Build Speedy is offered globally. We aim to comply with applicable laws in the jurisdictions where our users live, including the GDPR (EU/EEA), UK GDPR, CCPA/CPRA (California), LGPD (Brazil), PIPEDA (Canada), and Vietnam's data-protection laws. If a provision of these Terms is unenforceable in your jurisdiction, the mandatory consumer-protection rules of your local law apply and the rest of these Terms remain in effect.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection law in your country of residence requires otherwise. Disputes shall first be addressed informally by contacting support@buildspeedy.pro; we will attempt in good faith to resolve them within 60 days. If unresolved, disputes shall be submitted to the competent courts of Vietnam, except where mandatory law gives you the right to bring proceedings in your country of residence. Nothing in this section limits your statutory consumer rights.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. For material changes, we will notify subscribers by email or a prominent website notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

18. Miscellaneous

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Build Speedy regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a sale, merger, or reorganization.
